DATA PROCESSING CONSENT

BELL-KENZ PHARMA, INC. (hereinafter, the “COMPANY”) will, in the course of its business and its consideration of your application as an applicant of the COMPANY, process data relating to you including the information you have provided in this application form, information for identification and other personal circumstances, contact information, educational attainment, and family and employment background, government-issued information peculiar to an individual, information relating to pending or decided cases in court or an administrative agency, information relating to your health, and information relating to your professional and personal references; (hereinafter collectively referred to as “Personal Data”).

In view thereof, you provide consent to the COMPANY to process your Personal Data, as provided under applicable laws, regulations, and the Company’s policies, for its business purposes. These purposes include, but are not limited to, determining your qualifications and fitness for the position applied for, conducting interviews, demonstration of skills and competencies, pre-employment screening, and background checks or other similar processes.

You also confirm that, before providing us with the Personal Data of your family members, former colleagues, and professional and personal references (your contacts, for brevity), you would have obtained their consent to: (i) you collecting their Personal Data; (ii) you sharing the same with the COMPANY; and (iii) to the processing of their Personal Data by the COMPANY as provided herein.

The Personal Data will be retained in the COMPANY’s records throughout the duration of your employment, and for a reasonable period in accordance with applicable laws and regulations (Personal Data Retention Period). Unless retention for a longer period is required for reasonable cause, the disposition of Personal Data shall, upon the lapse of the Personal Data Retention Period, be effected by the Company in accordance with applicable laws and regulations.

You and your contacts are entitled to certain rights in relation to the Personal Data that may be collected from you (and from your contacts), including the right to access, correction, and objection to the processing, as well as the right to lodge a complaint before the National Privacy Commission in case of violation of your or your contacts’ rights as data subjects.
